PURPOSE:
To provide clarity on the implementation of the amended Regulation 18 in relation to the Form LLL.
BACKGROUND:
Regulation 1 8 is amended by the addition of sub-regulations (4) and (5) to provide for a form to be completed for purposes of the collection of personal information relating to the race, gender, citizenship and nationality of landowners in South Africa. The information is required for statistical and land audit purposes only.
Regulation 1 8(4) provides for completion and signing of the form (Form LLL), by a transferee, or, where there is no transfer of land, by the registered owner or holder. It further provides for completion and signing of the form by an attorney, conveyancer, notary public or statutory officer on information received.
PROCESS/PROCEDURE TO BE FOLLOWED:
- Form LLL must be lodged with all deeds/documents pertaining to land/mortgage and notarial bond registration transactions.
- It should be stapled on the inside cover of the deed and not linked as a document.
- Deeds/documents are not to be rejected if the Form LLL is not lodged. A prep note must be raised by the examiner.
- NB: Information contained in Form LLL that does not relate to a name, identity number, date of birth or registered number, as case may be, must not be disclosed in any deed or document lodged for registration or execution. (for example: race, gender, nationality)
- The correct Form LLL to be followed (see Government Notice No. 5948 in
- Government Gazette No. 52219 dated 05 March 2025 a copy herewith is attached)
- Heading must refer to form LLL.
- The Form must also contain the Firm number.
- The Lodgement of Form LLL will not be required when dealing with the registration of the Power of Attorney and Antenuptial Contract.
The below mentioned example must be followed during examination:
- When dealing with a single Bond Cancellation— Form LLL must be lodged.
- Section 4(1) (b) — Form LLL must be lodged
- When dealing with a single bond transaction — Form LLL must be lodged.
- When dealing with a set of three (T/BC/B) — Form LLL must be lodged with the transfer documents because it must be completed by a transferee. (number 1 of the batch)
The above-mentioned procedure/position is applicable to deeds/documents lodged from 5 April 2025.
EFFECTIVE DATE:
The Circular will be effective immediately.
