Registrars Circular Deeds Office

Department: Agriculture, Land Reform and Rural Development, Republic of South Africa Applicable Registries: North West (Vryburg) and North Gauteng

1. Purpose

This circular outlines the change of jurisdictional areas, the transfer of records, and the registration of properties situated in the North West Province (within the Dr Ruth Segomotsi Mompati District Municipality).

Effective 01 June 2026, these properties will transition from the jurisdiction of the North Gauteng Deeds Registry to the North West Deeds Registry, Vryburg.

2. Registration Time Frames

  • Last Day for Lodgement (North Gauteng): 20 May 2026. No further transactions for affected properties will be accepted after this date.
  • Effective Date for Lodgement (North West, Vryburg): 01 June 2026.
  • Last Day for Registration (North Gauteng): 29 May 2026.
  • Rejections: Deeds rejected in North Gauteng not re-lodged by 20 May 2026 must be re-lodged in Vryburg as a new lodgement with a new barcode.

3. Permanently Filed Titles (Counter Covers)

Titles and bonds for affected properties currently filed in North Gauteng must be withdrawn by 29 May 2026.

  • Firms failing to withdraw by this date will be billed annually until withdrawal.
  • The North West Deeds Registry (Vryburg) will not accept references to permanently filed titles held in North Gauteng.

4. General Power of Attorneys

  • If a General Power of Attorney is filed in North Gauteng and required for use in Vryburg, the provisions of Regulation 65(6) and (7) of the Deeds Registries Act 47 of 1937 must be met.
  • Alternatively, conveyancers may apply for the registration of a new General Power of Attorney in Vryburg.

5. Transactions Involving Both Deeds Registries

Special procedures apply for properties or bonds spanning both jurisdictions:

5.1. Simultaneous Transactions

  • If an owner wishes to transact with properties falling under both registries simultaneously, they must apply for a Certificate of Registered Title for the relevant property, to be lodged in the registry holding jurisdiction over that specific property.
  • Copies of documents that cannot be produced as originals must be endorsed and commissioned as true copies.

5.2. Endorsements on Title Deeds

As of 01 June 2026, Registrars will endorse title deeds containing properties in both registries to indicate which parts of the deed are inactive in that specific registry. The endorsement will read:

“Endorsement in terms of section 3(1)(v) of Act 47 of 1937. By virtue of the fact that the property described in paragraph(s) …… herein was registered in the deeds registry at ……, this deed in so far as it relates to the aforesaid paragraph, may only be dealt with in the North Gauteng Deeds Registry / North West Deeds Registry, Vryburg.”

5.3. Bond Cancellations

When a bond covers properties in both registries, it is the lodging conveyancer’s responsibility to ensure:

  • Original consents to cancellations are lodged in both registries.
  • The original bond is lodged in one registry, with an endorsed copy in the other.
  • Registration occurs simultaneously in both registries.

6. Issuing of VA Copies

Registrars may issue copies in terms of Regulation 68(1) for titles containing properties in both registries, but these are only valid for the specific property/jurisdiction covered. Advertisements published before 01 June 2026 in compliance with regulations do not need to be re-advertised.
