The legal profession has always been guided by high standards of ethics, transparency, and fairness. Clients rely on lawyers not only for expertise, but for trustworthiness in representation and billing. With the rapid integration of artificial intelligence (AI) tools into the law offices, whether in drafting contracts, conducting research, or analysing case law, new ethical questions are emerging. The biggest one is how lawyers should bill clients for work that has been substantially assisted by AI?
The Change AI Brings to Legal Work
AI-driven platforms dramatically reduce the time it takes to perform tasks traditionally billed by the hour. Research that might once have required days of paging through law reports can now be completed in minutes. Similarly, drafting a standard agreement might involve only a few AI prompts instead of hours of manual composition. While this boosts efficiency, it disrupts the long-standing “billable hour” model used in many law firms.
Lawyers are not simply selling time; they are selling judgment, strategy, and the ability to apply nuanced legal principles to complex problems. However, when AI takes over the heavy lifting, billing clients as though the work was performed entirely by the lawyer raises some serious questions.
South African lawyers are bound by the Legal Practice Act, the Code of Conduct for Legal Practitioners, Rules for the Attorneys and the Legal Practice Council. These require that fees be fair, reasonable, and disclosed transparently.
Overstating the time spent on work or failing to disclose that AI performed the bulk of it, could result is serious charges and or penalties.
Billing Models for an AI-Enabled Law Firm
Lawyers should consider evolving their billing practices. Several approaches can preserve both transparency and fairness, here are three:
- Flat Fees for Routine Work
For tasks like drafting contracts, wills, or standard pleadings (areas where AI excels), flat fees may be more ethical and client-friendly than hourly billing. The lawyer’s value lies in reviewing, tailoring, and ensuring accuracy, rather than in the time AI saved. - Hybrid Billing Models
Lawyers might charge for their professional oversight and analysis, while separately disclosing costs for AI tools. For example, a client could see a line item for “AI-assisted document generation” alongside “Attorney review and advice.” - Value-Based Billing
This model ties compensation to the outcome rather than to hours or technology used. It ensures they are paying for the outcome rather than the hours saved by technology. If AI allows an attorney to draft documents or conduct research in a fraction of the time, the client still benefits from the lawyer’s oversight, expertise, and strategic advice.
Moral Responsibility Beyond the Rules
Beyond the formal requirements of the Legal Practice Act and LPC Code, lawyers carry a moral responsibility. Clients often approach lawyers in moments of difficulty, disputes, family breakdowns, criminal charges, or financial stress. Trust is central. If clients feel they are being misled or overcharged for work largely performed by AI, that trust disappears quickly.
Transparency is not just a compliance matter; it is a moral imperative. Clearly stating when AI is used, specifying the lawyer’s contribution, and billing transparently shows respect for clients.
By proactively adopting fair billing models, South African lawyers protect not just their clients but the credibility of the profession.
The rise of AI in law is inevitable, and its benefits are undeniable. However, it also demands that lawyers rethink old habits, especially billing practices rooted in a pre-AI world. Ethical lawyering means not hiding behind tradition to justify inflated fees, but embracing transparency, fairness, and client service.
Lawyers who bill honestly for AI-assisted work demonstrate that technology does not diminish their value; it enhances it. Their role is not replaced by AI, it is redefined.
