DEEDS REGISTRIES ACT, 1937 (ACT No. 47 OF 1937): AMENDMENT OF REGULATIONS

In terms of section 9(9) of the Deeds Registries Act, 1937 (Act No. 47 of 1937), I, Mzwanele Nyhontso, Minister for Land Reform and Rural Development, hereby approve the regulations contained in the Schedule as made by the Deeds Registries Regulations Board under section 10 of the said Act. The Regulations will come into operation one month from the date of publication hereof in the Gazette.

SCHEDULE

1. In this Schedule “the Regulations” means the regulations promulgated by Government Notice No. R. 474 of 29 March 1963, as amended.

2. The schedule of Fees of Office as prescribed by regulations 84 and 86 of the Regulations is hereby substituted for the following Schedule:

(Prescribed by regulation 84)

1. For services rendered regarding the registration of –
(a) Lodgement fee (excluding RDP Housing)

A lodgement fee is payable each time a deed/document is lodged for purposes of registration in a deeds registry. In other words, the fee is also payable upon the re- lodgement of deeds / documents after rejection / withdrawal, etc.
(Note: The fee is payable per lodgement cover, and not on the number of deeds / documents contained in such a cover. For example, where a batch of 3 is lodged, then the fee is payable per cover (R50 x 3 covers)).
(b) A transfer of which the purchase price plus any additional consideration (if any) for such acquisition / the fair value of property, whichever is the greater –

– Item 1 (d) is added and provides for the payment of a fee for the registration of a notarial lease, sub-lease, and a cession of a lease. This fee is payable based on the consideration / value of the lease.

(e) A cancellation of, or release of a person or property from the operation of a registered mortgage or notarial bond, and an application in terms of section 4(1)(b) of the Act169.00
(f) Consent to any other act of registration in relation to the security hypothecated under registered mortgage bond.169.00
– Item 1 (f) is added and provides for the payment of a fee for consents in respect of any other acts of registration in relation to the security hypothecated under a registered mortgage bond (for example: consent to consolidation / subdivision, part-payment, cessions, substitutions, etc). See regulation 39 of the Deeds Registries Act, 1937 in this regard.
(Note: Consents as contemplated in Item 1(f) must be lodged in separate lodgement covers).
(g) Any other registration or annotation in registers or records, including certificates of title and all other registrations which are not exempted by a law or where no purchase price is involved474.00
(h) Withdrawal of deed/document lodged for registration (only for account holder requesting such withdrawal and regardless of number of deeds/documents in the batch)256.00
2. For a certificate or an affidavit by a registrar of any fact137.00
3. (a) For a report/supplementary report to Court made by a registrar in terms of section 97 of the Act702.00
(b) For a report/supplementary report to Court unilaterally made of section 97 of the Act by a registrar in terms0.00
4. (a) For a copy of a deed or document obtained through any other electronic system or issued by a registrar in terms of regulations 66, 67, and 70 – per copy103.00
– Item 4(a) is amended to provide for the payment of a fee for obtaining a copy of a deed document through ‘any other electronic system or issued by a registrar in terms of regulations 66. 67 and 70’. The amendment now provides for payment per deed / document, and no longer per page of a document only.
(b) For the application and of the issuing of a certified copy of a deed in terms of regulation 68(1) – per copy624.00
(c) For the keeping of the registrar client’s copy of a deed, on approval and at discretion of –
per copy / per year / or part thereof

5. (a) For an enquiry relating to a person, property or deed18.00

(f) For viewing and/ or downloading a deed or document through any electronic system: – per deed or document103.00
– Item 5(f) is amended to provide for the payment of a fee for viewing and / or downloading a deed / or document through any electronic system.
(g) For any unattended continuous search for information including the taking of notes, photographs or voice recordings for every 30 minutes or part thereof26.00
(h) For any enquiry not specially provided for, a fee to be fixed by the registrar, provided the minimum fee shall be18.00
(i) For Statistical and Analytical reports consisting of the following records: Number / Range of Registration or Recordal records read to produce report

– Item 6 is amended to provide for the payment of a fee for ‘transmitting any certificate, deed, document or any other information by using fax or any other electronic media.’ The relevant fee is payable per copy transmitted, and not per page
of such deed / document.
7. (a) For registering as a DeedsWeb user a non-refundable administration fee of217.00
b) For reconnecting a DeedsWeb user whose service has been suspended because outstanding debts291.00
(c) For subscribing as DeedsWeb user – per month18.00
8. For any information, copy or other service referred to in this Schedule, other than the registration of deeds and documents, which may be required by the Accounting Officer of the Department of Land Reform and Rural Development or her or his delegate, for her or his official purposes.0.00

EXEMPTIONS

No fees shall be levied by a registrar in respect of the performance of any act prescribed in section 3(1)(w) of the Act.

PAYMENT OF PRESCRIBED FEE PRIOR TO SERVICE BEING RENDERED

Regulation 4A is to be amended to provide for the Fees of Office to be paid prior to services being rendered. Regulation 4A (2) reads as follows:

“(2) The prescribed fees as referred to in the Schedule of Fees of Office as prescribed by regulation 84, must be paid prior to any service being rendered.”
