Withdrawal of Registrars Circular 6/2016 regulating the VA procedures for execution
1.PURPOSE
In line with changes made to regulation 68(1) of the Deeds Registries Act 47/37, Registrars Circular 6/2016 has become redundant /irrelevant and must be withdrawn. The issuing of CRC 1/2019, CRC 3/2020and CRC 1/2021 supports the withdrawal and replaces the need for RC 6/2016.
2.BACKGROUND
RC 6/2016 was issued to mitigate fraudulent transactions taking place upon the issuing of a VA copy of a title in place of the original thereof. A procedure was implemented at execution for the verification of the conveyancer applying for the registration of a VA copy. However various Chief Registrar Circulars has been issued, dispensing with the need for this procedure.
3.REASONS FOR WITDRAWAL OF RC 16/2016
– Clause 2.2 in CRC 1/2019 makes provision for the amendments of Regulation 68(1 E) (a) to (c).
– Clause 2.3 in CRC 3/2020 makes provision for the disclosure of the legal practice council number of conveyancers and appearers appointed in the power of attorney.
– Clause 2.3 in CRC 1/2021 makes provision for the issuing of a VA copy of a Bond and for the cancellation thereof by the amendments of regulation 68(11B) and regulation 68(11C).
4.RESOLUTION
RC 6/2016 is hereby withdrawn in toto.
5. DATE OF IMPLEMENTATION
This Circular will be applicable on date of issue.
